RE: The tariff classification of Levalbuterol Hydrochloride vials in dosage form, from India
Dear Ms. Keeler:
In your letter dated April 3, 2020, you requested a tariff classification ruling.
Levalbuterol Hydrochloride, imported in dosages of 0.31 mg/3 ml, 0.63 mg/3 ml, and 1.25 mg/3 ml vials, is a bronchodilator. It is indicated for the treatment of asthma and chronic obstructive pulmonary disease (COPD).
The applicable subheading for the Levalbuterol Hydrochloride vials in dosage form will be 3004.90.9285, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses…or in forms or packing for retail sale: Other: Other: Other: Medicaments primarily affecting the eyes, ears or respiratory system: Other: Other.” The rate of duty will be free.
